Standard Terms and Conditions

LAUREL COTTAGE TERMS AND CONDITIONS

PLEASE READ THESE TERMS & CONDITIONS CAREFULLY. WHEN YOU MAKE A RESERVATION WITH US (WHETHER BY EMAIL, TELEPHONE OR POST), THESE CONDITIONS ARE DEEMED TO HAVE BEEN ACCEPTED BY YOU.

1) Laurel Cottage is owned and managed by Mark and Tamsin Terry-Lush of The Rowans, Chaxhill, Westbury on Severn, Gloucestershire, GL14 1QP, UK (‘the Property Owner’).

2) Seven night lets run from either Friday or Saturday at 4pm to Friday or Saturday at 10am unless otherwise stated.

3) Immediately upon receipt of booking confirmation the Holidaymaker should check the details and notify the Property Owner immediately of any correction as soon as possible. The Property Owner reserves the right to charge a booking amendment fee to administer/correct any error by the Holidaymaker.

4) Prices include all electricity, heating, hot water, towels and bed linen (not cot bedding).

5) Smoking is not permitted inside Laurel Cottage. Any guest smoking inside Laurel Cottage will be asked to vacate before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim for reimbursement whatsoever.

6) No candles to be used in Laurel Cottage under any circumstances.  In the event of power loss only battery-powered lanterns may be used.

7) Sorry no pets. If a pet is brought to Laurel Cottage the Property Owner/caretaker can refuse to allow the Holidaymaker to take possession of the Property or make the Holidaymaker leave the accommodation before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim for compensation or reimbursement whatsoever.

8 ) Laurel Cottage is suitable for three (3) persons plus an infant. The names of all guests should be given on booking and under no circumstances should more than the maximum number occupy the cottage. Guests are permitted daytime visitors only where consent of the proprietors has been given.

RESPONSIBILITIES OF THE HOLIDAYMAKER

9) During the period of the holiday, the Holidaymaker undertakes the following:

(a) That the number of people occupying the Property will not exceed three (3) persons plus an infant. If this number is exceeded the Property Owner/caretaker can refuse to allow the Holidaymaker to take possession of the Property or make the Holidaymaker leave the accommodation before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim for compensation or reimbursement whatsoever.

(b) That the Property will be used solely for the purpose of a holiday by the Holidaymaker and his party.

(c) To show due consideration for other parties. If the Holidaymaker abuses the Property or displays dangerous, offensive or rude behaviour to the Property Owner/caretaker or any third parties (eg other guests, neighbours, contractors), the Property Owner/ caretaker has the right to ask the Holidaymaker to leave the accommodation before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim for compensation or reimbursement whatsoever.

(d) To allow the Property Owner or his representatives access to the Property at any reasonable time during the period of the holiday.

(e) To keep the Property and all furniture, utensils, equipment, fixtures and fittings in or on the Property in the same state of repair and condition as at the commencement of the holiday and to ensure that at the end of the holiday the Property is left in the same state of order and cleanliness in which it was found. The Property Owner reserves the right to levy an additional charge for any extra cleaning required after the Holidaymaker’s occupancy and for any consequential loss.

(f) To report as soon as possible to the Property Owner any breakages or damage caused by the Holidaymaker during the holiday and to reimburse the Property Owner with the cost of replacement. The Property Owner reserves the right to make a claim against the Holidaymaker for repair or loss as a result of damage caused.

(g) To notify all other members of the Holidaymaker’s party of these conditions.

(h) To arrive after 4pm on the arrival day and to vacate the Property by 10am on the day of departure unless prior arrangement has been agreed with the Property Owner.

(i) The Holidaymakers’ vehicles and their contents and the Holidaymakers’ personal belongings are left at the Property during (and after) the period of the holiday entirely at the risk of the Holidaymaker.

(j) The Holidaymaker must not (without the express permission of the Property Owner) allow any person other than guests booked and staying in the Property for their holiday to use the facilities and amenities of the Property.

10) No liability is accepted for injury to guests or damage to vehicles or other items belonging to them while on Laurel Cottage grounds or adjacent grounds belonging to The Rowans or Chaxhill Farm.

CANCELLATION POLICY

11a) The Holidaymaker should notify the Property Owner immediately and in writing of any intention to cancel the holiday booking. The cancellation only takes effect when the Property Owner has received written confirmation from the Holidaymaker via post and/or email.

(b) In the event of cancellation the deposit will be forfeit.

(c) Where a cancellation is made within four weeks of entry date no refund will be given. If a cancellation is made more than four weeks before entry date then a refund will only be made if the booked period is successfully re-let. If the booked period is re-let but at a lower price then only this lesser amount will be refunded.

(d) Should it be necessary for us to cancel a booking due to circumstances beyond our control (eg fire, flood, damage, illness etc.) then all monies paid will be returned in full. The proprietors will not be held responsible in any way for any other losses incurred by you.

(e) We recommend that holiday insurance is taken out to guard against any unforeseen circumstances.

PROPERTY OWNER LIABILITY

12a) The Property Owner shall accept no liability to the Holidaymaker for any loss, damage or injury howsoever caused to the Holidaymaker or to the Holidaymaker’s personal property (or to persons in the Holidaymaker’s party or their personal property) during their stay at Laurel Cottage except to the extent such loss, damage or injury is caused by the negligence or wilful default of the Property Owner.

(b) We reserve the right to amend the terms and conditions at any time and guests are advised to check these before booking. All information on our website is given in good faith and no responsibility is taken for inaccuracies. We reserve the right to change or withdraw or alter facilities at any time. Please check with us before booking.

COMPLAINTS

13) In the unlikely event the Holidaymaker may have cause for dissatisfaction, this should be made known to the Property Owner (or caretaker for the Property) as soon as possible verbally and followed up in writing.

FORCE MAJEURE

14) No liability can be accepted and no compensation will be paid by the Property Owner, where the Holidaymaker or his personal property suffer any loss, damage, injury, disappointment, inconvenience or otherwise, or where the performance or prompt performance of any obligations by the Property Owner are prevented or affected, by ‘force majeure’. In this contract ‘force majeure’ means any event which the Property Owner could not have foreseen or avoided including war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire; adverse weather conditions closure of international borders disease none availability of transport services interruption to services/utilities and all similar events outside the control of the Property Owner.

CONTRACT

15) All contractual obligations arising out of these conditions shall be subject to English Law and the exclusive jurisdiction of the English Courts.

WEBSITE/BROCHURE ACCURACY

16) While to the best of the Property Owner’s knowledge the details relating to Laurel Cottage described on the website or in the brochure were correct at the time of printing.  Laurel Cottage reserves the right to make alterations at any time and shall endeavour to inform the Holidaymaker of any such alterations. Laurel Cottage cannot accept responsibility for any changes or closures to area amenities or attractions mentioned online or in print.
